TERMS & CONDITIONS

These Terms of Use constitute a legal agreement between you and Treasure Island Media and spell out the terms and conditions to which users of the Streaming site(s), Store(s), and our Online Communities (the “Site”) must adhere. Please read it carefully before using the Site or purchasing any goods or services on the Site, because by using the Site, you agree to be bound by the terms (including our Privacy & Cookie Policy) set forth here. If you do not agree with or do not wish to be bound by all of the terms and conditions of this Agreement, do not use the Site. We reserve the right to amend these Terms of Use at any time.

1. 1. AGE REQUIREMENT

   In order to use the Site or purchase a subscription on our membership sites or any other purchases in our store, you must be at least 18 years old or the applicable age of majority in the jurisdiction where you reside. You hereby represent and warrant to Treasure Island Media that you are over the age of 18. You also represent and warrant to Treasure Island Media that you possess the legal authority to enter into this agreement, as well as to enter into a contract for the purchase of the Site.

   To comply with applicable state and federal laws, access to age-restricted areas and purchases of adult-themed products or services require successful completion of an independent age and identity verification process. By accessing or using the Site, you consent to verification of your age and identity through a secure, third-party verification service. Treasure Island Media does not collect or store your identification documents, biometric data, or other personally identifying information used during that verification process; only the verification result (pass/fail) and timestamp are retained for compliance purposes.

   If verification cannot be completed, fails, or indicates that you are below the minimum legal age required in your jurisdiction, your access to age-restricted content or purchases will be denied. Users located in jurisdictions that require additional verification or prohibit certain adult content may face additional access restrictions in accordance with those laws.

2. 2. ADULT MATERIAL

   ADULT-THEMED NATURE OF THE SITE’S PRODUCTS, SERVICES AND MEMBERSHIPS: THIS IS AN ADULT-THEMED SITE AND THE PRODUCTS AND SERVICES OFFERED FOR PURCHASE ON THIS SITE ARE FOR ADULTS ONLY. By using the Site, you agree that you do not object to viewing or utilizing sexually explicit materials. You further represent to Treasure Island Media that you are familiar with the standards of the community in which you live pertaining to sexually explicit materials, and that you believe that the materials available from this Site will not offend the standards of that community. You agree that, in no event, will you permit any minor to see any of the content available on the Site or view or otherwise utilize or have access to any of the products or services purchased by you.

   You understand that viewing, downloading, or purchasing sexually explicit material is at your sole discretion and risk, and that you are solely responsible for compliance with all local laws governing such material in your jurisdiction.

3. 3. OWNERSHIP OF INTELLECTUAL PROPERTY

   All materials published or made available from the Site are protected by copyright, trademark and all other applicable intellectual property laws. All intellectual property rights in the Site are owned by Treasure Island Media or used by consent of their owners. You agree that you will not copy, duplicate, reproduce, modify, adapt, translate, exhibit, publish, transmit, participate in the transfer, sale or resale of, create derivative works from, distribute, perform, display, reverse-engineer, decompile or disassemble any materials published or made available from the Site or any other Treasure Island Media products or services.

4. 4. LOSS OF USER ID OR PASSWORD

   You are responsible for keeping your confidential user ID and password secure. You may not share your user ID or password with any other party. In the event of any loss, theft, or unauthorized disclosure or use of your user ID or password, you agree to immediately notify Treasure Island Media at customerservice@treasureislandmedia.com or 877-553-8181. You understand that you will be liable for any unauthorized use of the Site or purchase resulting from any use of your user ID or password by any other party.

5. 5. PASSWORD SHARING

   A user cannot log in to the website on more than one computer at a time. Users can log in from up to 3 IP addresses within 60 minutes. When a user is simultaneously logged in from more than one device, their account will be locked for 20 minutes. Password sharing may result in account termination without refund.

6. 6. MAINTENANCE OF ACTIVE EMAIL ADDRESS

   You agree at all times to maintain an active email address. You agree to receive email announcements that may contain sexually explicit content from Treasure Island Media. You understand that Treasure Island Media may terminate your access to the Site, in whole or in part, in the event that your email address becomes inactive.

7. 7. DISCLAIMER OF WARRANTIES

   EXCEPT AS EXPRESSLY PROVIDED HEREIN, YOU AGREE THAT USE OF THE SITE AND PURCHASE OF ANY OF THE PRODUCTS AND SERVICES ARE ENTIRELY AT YOUR OWN RISK. THE SITE AND THE PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” OR “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED. TREASURE ISLAND MEDIA DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE SITE AND ITS PRODUCTS AND SERVICES. TREASURE ISLAND MEDIA FURTHER DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH THE SITE OR ITS PRODUCTS AND SERVICES.

8. 8. TERMINATION

   Treasure Island Media may, in its sole discretion, terminate or suspend your access, at any time and without notice, to all or part of any of the Site or refuse to sell you any of the Products and Services for any or no reason, including, without limitation, your breach of these Terms of Use.

9. 9. INDEMNITY

   You agree to indemnify and hold Treasure Island Media, its officers, directors, employees and its and their successors and assigns harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of your use of the Site or your violation of any of the provisions of these Terms of Use.

10. 10. REPORTING ABUSE

    If you think anyone is violating any of the Terms, please notify us immediately. If you think anyone has posted material that violates any protected or copyright materials, you can notify us at legal@treasureislandmedia.com.

    If you believe you were denied access to the Site or content in error due to age or identity verification, or wish to report any misuse of our age-verification system, please contact compliance@treasureislandmedia.com. We will review all such reports promptly and take appropriate action in accordance with applicable law.
